This Acceptable Use Policy ("Policy") sets out the rules and guidelines for using the Trulience platform, services, and Avatars. This Policy forms part of our Customer Terms of Service and applies to all Customers and Authorised Users.
Violations of this Policy that are deliberate, repeated, or place an undue burden on our Services may result in suspension or termination of your access. We reserve the right to update this Policy from time to time, and material changes will be communicated with reasonable notice.
1. GENERAL REQUIREMENTS
When using our Services, you must:
- Comply with all applicable laws and regulations, including those relating to intellectual property, data protection, privacy, and electronic communications;
- Use the Services for legitimate business or organisational purposes;
- Implement appropriate security measures to prevent unauthorised access to your account and any Avatars or content you create;
- Monitor activity on your account and promptly report any suspected misuse;
- Ensure that the use of Avatars, including voices and likenesses, respects the rights and interests of all individuals involved;
- Obtain and maintain all necessary consents, permissions, and licences required for your use of the Services.
2. IMPERSONATION, DECEPTION AND RIGHTS VIOLATIONS
You must not use the Services to:
- Impersonate any person, organisation, or entity with the intent to deceive, defraud, or mislead others;
- Create content that falsely represents endorsement, affiliation, or sponsorship by any individual or organisation;
- Violate the privacy, publicity, or intellectual property rights of any third party;
- Engage in fraud, identity theft, phishing, or any form of financial deception;
- Transmit communications that misrepresent their origin or use spoofed identities;
- Create or distribute content that is defamatory, libellous, or designed to harass, threaten, or intimidate;
- Produce content that promotes discrimination based on race, ethnicity, gender, religion, sexual orientation, disability, or any other protected characteristic.
3. PROTECTION OF MINORS
The protection of children is paramount. You must not use the Services to:
- Create, distribute, or facilitate any content that exploits, abuses, or endangers minors in any way;
- Produce any content depicting minors in sexual, violent, or otherwise inappropriate situations;
- Use Avatars representing minors for any adult, sexual, or age-inappropriate content;
- Facilitate contact between adults and minors for inappropriate purposes;
- Collect or solicit personal information from minors without verifiable parental consent.
Any suspected violation involving the exploitation or abuse of minors will be reported to the appropriate law enforcement authorities.
4. MISINFORMATION AND PUBLIC HARM
You must not use the Services to:
- Create or spread misinformation, disinformation, or propaganda designed to deceive the public;
- Produce content that could reasonably be expected to incite violence or cause public harm;
- Remove, obscure, or tamper with any watermarks, metadata, or other indicators designed to verify content authenticity or provenance;
- Send unsolicited bulk communications or spam;
- Provide material support to organisations designated as terrorist groups;
- Use the Services in any manner that creates a risk of death, serious physical injury, or damage to critical infrastructure.
5. PLATFORM SECURITY AND INTEGRITY
You must not:
- Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the Services;
- Circumvent, disable, or interfere with any security features or access controls;
- Gain or attempt to gain unauthorised access to any systems, networks, or data;
- Upload or transmit viruses, malware, or any other harmful code;
- Scrape, harvest, or collect content or data from the Services for the purpose of training artificial intelligence or machine learning models;
- Share your account credentials or provide access to the Services to anyone other than Authorised Users;
- Sublicense, resell, or redistribute access to the Services without our prior written consent;
- Use the Services to build a competing product or service;
- Consume computational resources in an excessive or abusive manner that degrades service quality for other users;
- Abuse any referral programmes, promotional offers, or free tier allocations.
6. STOCK AVATAR USAGE RESTRICTIONS
When using Stock Avatars provided by Trulience, you must not:
- Use Stock Avatars in a manner that falsely implies personal endorsement by the individuals whose likenesses were used to create them;
- Attribute personal opinions, beliefs, or characteristics to Stock Avatars that suggest they represent real individuals;
- Use Stock Avatars in political campaign materials, news broadcasts, or televised content without prior written consent from Trulience;
- Create non-fungible tokens (NFTs) or similar digital assets incorporating Stock Avatars;
- Incorporate Stock Avatars into patent applications or trademark registrations;
- Use Stock Avatars in paid social media advertising campaigns without prior consent.
For Custom Avatars created using the likeness of specific individuals, you must obtain and maintain explicit consent from those individuals for all intended uses.
7. AUDIO CONTENT RESTRICTIONS
When using voice models or audio content provided through the Services, you must not:
- Use stock audio content as commercial musical themes, jingles, or signature audio branding without appropriate licensing;
- Remix, substantially alter, or create derivative works from stock audio beyond basic editing adjustments;
- Use stock audio in international broadcast advertising for enterprises with annual revenues exceeding one billion pounds without prior written consent.
8. REPORTING VIOLATIONS
If you become aware of any violation of this Policy, please report it immediately to info@trulience.com. We take all reports seriously and will investigate promptly.
9. CONSEQUENCES OF VIOLATION
Violations of this Policy may result in:
- Removal of content that violates this Policy;
- Temporary suspension of access to the Services;
- Permanent termination of your account;
- Reporting to relevant law enforcement authorities where appropriate;
- Legal action to recover damages or enforce our rights.
The specific consequences will depend on the nature, severity, and frequency of the violation.
